Va. man charged with having sex with teen while infected with HIV

RICHMOND, Va. — A Chesterfield County man is facing charges he had sex with a 14-year-old girl while infected with HIV.

Andre Russell Harvin waived his preliminary hearing Thursday on charges of carnal knowledge and having intercourse while knowing he was infected with HIV. A judge certified the case to a grand jury.

State law requires disclosure of HIV, syphilis or hepatitis B before having sex.

The Richmond Times-Dispatch reports that the 52-year-old Harvin was arrested on the charges May 16, the day the girl’s family reported the sexual encounter. Authorities say the girl has chosen not to get an HIV test.

The charges come less than a year after a murder count again Harvin was dismissed because prosecutors concluded he acted in self-defense when he fatally shot his girlfriend’s 18-year-old son.
