Randy Barnett (with commentary by me) on ‘Popular Sovereignty and Judicial Review’

March 24

Last month, co-blogger Randy Barnett came to the University of Chicago to present his next big idea — “Popular Sovereignty and Judicial Review.” I had the pleasure of being his commentator. The audio for the talk is now online, for those of you who’d like to hear your co-conspirators argue rather than just reading them.

The recording is about an hour. My comments start at 40:40; Randy’s response starts at 46:40.

Will Baude is an assistant professor at the University of Chicago Law School, where he teaches constitutional law and federal courts. His recent articles include Rethinking the Federal Eminent Domain Power, (Yale Law Journal, 2013), and Beyond DOMA: State Choice of Law in Federal Statutes, (Stanford Law Review, 2012).
