The Supreme Court will hear oral arguments beginning at 10 a.m. today in the following cases:

Orff v. United States, No. 03-1566. Did the court of appeals correctly determine that plaintiffs could not sue the United States for an alleged contract breach between irrigators and the Westlands Water District because the plaintiffs are not intended third-party beneficiaries of that contract?

Exxon Mobil v. Saudi Basic Industries,No. 03-1696. May the doctrine that bars lower federal courts from conducting de facto appellate review of state court decisions be interpreted to divest federal courts of jurisdiction solely because a pending state-court proceeding presents identical issues, despite the long-established system of dual federal and state jurisdiction?
