Ballot Questions

Question A
Ethics Code

Amend Section 410 and repeal Section 411 of the County Charter to retain the requirements that the Council adopt a code of ethics applicable to all County officers and employees and explicitly require that the code must include certain provisions; to delete from the Charter certain specific restrictions on the activities of County employees and contractors; and to expressly allow the Council by law to create an ethics commission to enforce and interpret the law and to allow the commission to retain its own legal counsel the approval of the County Attorney.

Question B
Biennial Capital Improvements Program

Amend Section 302 of the County Charter to require the County Executive to submit the County Capital Improvements Program to the County Council, and the Council to approve the Program, in each even-numbered year rather than annually; and to allow the Council to amend an approved Capital Improvements Program at any time by an affirmative vote of 6 Councilmembers.

Question C
Property Tax - Relation to Income Tax

Amend Section 305 of the County Charter to:

  • require the County Council, when setting rates form real property tax, to reduce the total revenue produced by the tax in any fiscal year by the amount of revenue received during the preceding fiscal year from the county income tax which exceeds the revenue that would have been received if the income tax rate were 56% of the state income tax; and
  • allow property and income tax rate to be overrdidden only in an emergency by a unanimous vote of all Councilmembers.

Question D
Budget Adoption - Majority Vote

Amend Section 305 of the County Charter to reduce from 6 to 5 the number of Councilmembers needed to approve an annual operating budget which exceeds the previous year's budget by more than the rate of inflation, and to reduce from 7 to 5 the number of Councilmembers needed to approve an annual operating or capital budget which exceeds the Council's spending affordability guidelines in effect for that fiscal year. Question E
Fire and Rescue Department

Add Section 219 to the County Charter to provide that on County-wide Fire and Rescue Department, headed by a County Fire Chief, would have full operational and administrative authority over all fire, rescue, emergency, and related services in the County. The Chief would have the power to direct, control, and coordinate the delivery of fire, rescue, and emergency services by volunteer firefighters as well as County employees. The legal authority of the other public or private entities in delivering these services would be subordinate to the Chief's authority.

Question F
Alcohol Beverages - 12th Election District (Damascus)

To authorize the Montgomery County Board of License Commissioners to permit hotels and restaurants to sell beer and light wine for the consumption on the premises in Damascus (12th Election District)

Note: Question F will be voted on only by the legally qualified voters of the 12th District Election District.
