All of the current justices on the Supreme Court came directly from the federal courts of appeals. Elena Kagan is the third U.S. solicitor general to be nominated while serving in the job. Besides Kagan, five who served at one time in the post have been nominated, and all but one -- Robert Bork -- were confirmed.
