Five more persons were convicted yesterday of trespassing at a legal abortion clinic in Alexandria last year. Like two other defendants convicted last week, all were sentenced to one day in jail.

Alexandria Circuit Court Judge Donald H. Kent delayed imposing the sentences after the five said they would appeal to the Virginia Supreme Court.

The incident that has now resulted in seven trespass convictions was a six-hour sit-in last Sept. 15 at the Alexandria Women's Clinic, 101 S. Whiting St. The defendants have said they oppose abortions on moral grounds.

Convicted yesterday were Jeanne M. Gaetano, 2509 Urbana Dr., Wheaton; David J. Gaetano, 18700 Walkers Choice Rd., Gaithersburg; Mary K. Bailey, 2016 Carr Hill Rd., Vienna; Karen Ann Torres, 6471 Fenestra Ct., Burke, and Mary Ann Kritzer, 2503 Lisbon La., Alexandria.

One defendant was aquitted yesterday because none of the prosection witnesses could place her at the scene of the incident. She is Deirdre M. Byrne, 1011 Priory Pl., McLean.

One other person is scheduled to be tried on a trespass charge in the incident. The trial is scheduled for next month.

Maximum penalty for trespass is 12 months in jail and a $1,000 fine.
