A 64-year-old Washington man has been arrested on a warrant charging him with second degree murder in a fatal shooting Saturday that apparently stemmed from a confrontation over a seat in a Northeast restaurant, D.C. police reported.

Police said Clyde N. McClellan, of 1519 Benning Rd. NE, was arrested Monday in Silver Spring and charged as a fugitive. He was returned to the District yesterday and was being held last night at police headquarters pending arraignment on the murder charge in D.C. Superior Court.

The shooting occurred about 9:45 p.m. at Speed's Restaurant, 1374 H St. NE, after the victim, Truby Snow, 55, refused to yield his seat to another man, police said. They said the man then drew a pistol and shot Snow once in the neck. Snow, of 226 14th Place NE, died about a half hour later.

In a separate homicide case, a Southeast man was arrested yesterday in the March 17 shooting death of Steven Birks, 17, of 238 Portland St. SE, who was slain at 12th and I streets SE in the Potomac Gardens housing project.

Police said Shahid Turner, 21, of 1064 Wahler Place SE, had been charged in a warrant with felony murder.
