Judge Albert B. Fletcher Jr. of the U.S. Court of Military Appeals denied in testimony yesterday in Fairfax Circuit Court that he told an undercover police officer that he wanted to engage in a homosexual sex act last Oct. 24.
Fletcher is charged with felony solicitation to commit oral sodomy, and faces a maximum of five years in prison if he is convicted. Authorities said that he was among 16 persons arrested by Fairfax police at known homosexual gathering places in the county. All the others pleaded guilty to a lesser misdemeanor charge, and most were fined $100. Fletcher rejected that course.
The police officer testified that Fletcher approached him at the Belle Haven Marina and initiated a conversation about sex. The jury was given the case yesterday, deliberated 90 minutes without reaching a verdict and will resume deliberations today.
