For the second time within a year, the D.C. Zoning Commission agreed this week to reconsider a request from the owners of the Fourways Restaurant near Dupont Circle to rezone its property to permit the construction of a seven-story condominium.
Attorneys for Walter Sommer, general partner of Fourways of Washington Ltd., which owns the property, filed for the reconsideration of the application after the commission voted last month to deny its rezoning request.
The commission voted 3 to 1 this week to reopen the zoning case despite strong opposition from several neighborhood citizens groups that fear that the condominium will lead to a series of commercial development rezonings in a neighborhood where they would like to limit the amount of traffic.
The commission's decision now goes to the National Capital Planning Commission, which must review it within the next 30 days. It will make its recommendation to approve or deny the application to D.C. zoning officials, who may make the final decision on the Fourways case at their Feb. 8 meeting, according to Cecil Tucker, the commission's secretary.
Fourways officials have argued that they need the rezoning to prevent the company from going bankrupt. For the past 15 months, Dupont Circle area residents and Fourways officials have had two public hearings and filed numerous motions and letters debating the project.
"We're very disappointed," said Vernon Palmer, staff director of the Advisory Neighborhood Commission 2B. "We feel the commission did themselves and the public a disservice by taking this action and not sticking to its original decision."
Larry Tunison, president of Fourways of Washington Ltd., said if final approval is granted, the firm hopes to begin construction of the new building within six months of the decision.
