The Second Circuit held oral argument Tuesday in ACLU v. Clapper, the first of the appellate case on the lawfulness of the NSA’s telephony metadata program, presently authorized under Section 215. You can watch the video of the argument, which goes on for almost two hours, here via C-SPAN. I have posted my thoughts on the argument over at Lawfare. As I also noted at Lawfare, the ACLU drew an unusually good panel for its challenge.
