Attorney General Merrick Garland may be moving forward correctly in the interest of the Constitution and our democracy. Although I am no fan of the former president and consider myself a liberal or even progressive, Mr. Garland may be trying to push these cases to the Supreme Court, where they belong.

The Justice Department should be more concerned with criminality and civil rights violations and prosecuting election shenanigans — and less involved in deciding questions of the separation of powers, executive privilege and the like. Leave the latter to the Supreme Court.
